Terms Of Use

  1. These Terms of Use relate to your participation in the COCA‑COLA Designated Driver free Coca‑Cola drinks promotion (the ‘Promotion’).

  2. Participation in the Promotion requires acceptance of these Terms of Use.

  3. The Promotion commences on 1st December 2016 at 12.01am and ends on 6th February 2017 at 11.59pm unless otherwise extended, suspended or cancelled by the Promoter in its sole discretion (‘Promotion Period’).

Who Can Participate

  1. In order to participate in the Promotion you must:

    1. be aged 18 years or older at the time of registration;
    2. be a resident of New Zealand; and
    3. own a smartphone with available text and internet access capabilities.

How To Register For Your 3 Free Coca‑Cola Soft Drink Vouchers

  1. STEP 1: Text the short code ‘Driver’ to 345. Please note that sending and receiving text messages may attract a network carrier fee.

  2. STEP 2: When you text the short code to 345, you will receive a text message with a link to a mobile site to register to get three (3) free non-packaged Coca‑Cola soft drinks from participating outlets.

  3. STEP 3: To complete the registration process for the vouchers via the mobile site you will be required to:

    1. provide your name, a valid email address and select the venue that you are visiting from the drop-down list; and
    2. accept the Terms of use as specified here.
  4. You are only able to register to get 3 free Coca‑Cola soft drink vouchers once per 24 hours period (commencing from the time you txt ‘DRIVER’ to 345 and ending 24 hours later) during the Promotion Period.

How To Redeem Your 3 Free Coca‑Cola Soft Drink Vouchers

  1. Drinks are only able to be redeemed at participating outlets. A list of participating outlets can be found at www.coke.co.nz/driver

  2. In order for you to redeem a voucher within the mobile site you will need to:

    1. Tap on one of the 3 non-redeemed vouchers to activate it.
    2. Once activated, show your phone to the bartender before clicking the ‘REDEEM YOUR VOUCHER NOW’ button.
    3. You need to ensure that you only press the ‘REDEEM YOUR VOUCHER NOW’ button when the bartender is looking at your phone.
    4. Once the ‘REDEEM YOUR VOUCHER NOW’ button has been pushed an on-screen countdown will be initiated. Once counted down the voucher image will be updated to be shown as ‘ VOUCHER REDEEMED’.
    5. Repeat the above process for each voucher redemption, up to the available maximum of three (3) vouchers.
  3. Each voucher may only be redeemed for a selected Coca‑Cola soft drink product, subject to availability at the participating outlet. Redemption cannot be redeemed against any alcoholic beverage.

  4. If your vouchers are not redeemed within 24 hours they will expire. Vouchers must be redeemed on the same day as registration within the 24 hours period from txting in.

Using Your Name For Publicity Of The Promotion

  1. The Promoter may use the name entered in the ‘Your Name’ field of registered participants on the COCA‑COLA Designated Driver platform on live digital screens in the Auckland CBD. This could be used at the time of registration or the time of drink voucher redemption.

Safety And Etiquette During Use

  1. All Participants are expected to conduct themselves in a courteous manner during their participation in the Promotion and use of the COCA‑COLA Designated Driver platform. The Promoter reserves the right in their absolute discretion to exclude Participants from the Promotion and/or using the COCA‑COLA Designated Driver platform if you fail to comply with the directions or if you act in a manner that is dangerous or disruptive to you, to other Promotion participants, to bartenders (at the point of redemption or service) or to the public.

  2. Bartenders may deny redemption and/or refuse service to any Participant who in their reasonable opinion:

    1. is, or reasonably appears to be, intoxicated;
    2. is otherwise acting in a manner which is contrary to the venue’s patron conduct rules; or
    3. is seeking to abuse or undermine the intention or execution of the Promotion.
  3. The Promoter has a zero tolerance policy on harassment of any form, racism, and offensive behaviour and language. The Promoter reserves the right to exclude from the Promotion any Participant breaching this policy at their absolute discretion.

General Terms & Conditions

  1. The Participant will receive on screen confirmation of their voucher being redeemed. The Promoter accepts no responsibility for any mis-use of the mobile app where redemption is activated unintentionally, or where messages that are lost or delayed while sending, or which are unable to be sent due to lack of network coverage, operator or network error, or for any other reason beyond its control.

  2. If for any reason the administration, security, fairness, integrity, conduct or operation of this activity is interfered with or disrupted in any way by a cause outside the reasonable control of the Promoter (including but not limited to act of God; any act of a public enemy, war, civil unrest, or act of military authority; fire, flood, earthquake, landslide, or other elements of nature; any strike, lockout or other labour dispute; any act of a third party engaged in terrorist activity or sabotage; vandalism; tampering; power failures; computer bugs or  viruses; unauthorised intervention; fraud or technical failures), the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:

    1. to remove any Participant; and/or
    2. as appropriate, to modify, suspend, terminate or cancel; or recommence this activity,
  3. The Promoter takes no responsibility for lost, incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, computer equipment, software or any other error or malfunction. Neither can the Promoter be held responsible for the failure to fulfill the obligations of any of the third parties involved in this activity, although the Promoter will always endeavor to minimise the effect to the participant of any such failure.

  4. Except for any liability that cannot be excluded by law, the Promoter (including its directors, shareholders, officers, employees, contractors, advisors, assignees, agents, licensees, representatives, advertising and Promotional agencies) its related companies (the Related Parties) exclude all liability (including negligence), for any personal injury or death, or loss (including any damage, claim, injury, cost or expense); whether direct, indirect, special or consequential, arising in any way out of this activity, including, but not limited to, where attributable to any of the following:

    1. any negligence of a Relevant Party;
    2. any technical difficulties or equipment malfunction (whether or not under the Promoter's control);
    3. any theft, unauthorised access or third party interference;
    4. any registration that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; or
    5. any variation in use to that stated in these Terms of Use.
  5. Participants’ personal information will be collected by or on behalf of the Promoter to enable it to administer the COCA‑COLA Designated Driver platform. The personal information of Participants’ may be provided to others assisting in the conduct of the platform, including agencies associated with the platform. Participants may contact the Promoter by calling the toll free number 0800 505 123 to request access to, or corrections of, any of their collected personal information that is held by the Promoter.   6. The Promoter reserves its right to modify these Terms of Use at any time for any reason. You agree that you will be bound by such changes and that you will not hold the Promoter liable for any losses resulting from any such changes.

  7. These Terms of Use are governed by, construed in accordance with, the laws of New Zealand and the parties agree to submit to the exclusive jurisdiction of the Courts of New Zealand.

CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO THIS THE COCA‑COLA DESIGNATED DRIVER PLATFORM OR THE INFORMATION ASSOCIATED WITH THE COCA‑COLA DESIGNATED DRIVER PLATFORM OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS ACTIVITY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY  SUCH DAMAGE, INTERFERENCE OR UNDERMINING
